PRIVACY POLICY
Holdon Log, LLC Privacy Policy Agreement

This Privacy Policy explains Holdon Log, LLC's policy regarding the collection and protection of Personal Data supplied by users or collected by us from users of the PerformerTrack.com Web site and the PerformerTrack Online Application and Service (the "Application and Service").

Holdon Log, LLC defines "Personal Data" as any data from which it is practical to directly determine the identity of an individual. Any capitalized terms not defined in this Privacy Policy have the meanings given in the Holdon Log, LLC Terms Of Use Agreement (the "Agreement"):

This Privacy Policy may be updated by Holdon Log, LLC from time-to-time. Holdon Log, LLC will provide notice of materially significant changes to the Privacy Policy by posting notice on the PerformerTrack.com Web site as well as on the Application and Service.

By registering to use the Application and Service, you agree (1) to comply with the terms and conditions of this Privacy Policy and (2) that Holdon Log, LLC may process (i.e., collect, use, etc.) your Personal Data as described in this Privacy Policy or the Agreement. Personal Data may be processed by Holdon Log, LLC in the country where it was collected as well as other countries where laws regarding processing of Personal Data may be less stringent. 

HOW HOLDON LOG, LLC USES INFORMATION

Personal Data

We will not sell or market the e-mail addresses of registered Users to third parties. 

We will not view the information, data or files that you record, enter and/or upload using the Application and Service. 

We may ONLY view your Application and Service data or files that you record, enter and/or upload using the Application and Service in order to (1) provide technical support; (2) comply with the law; (3) protect and defend the rights or property of Holdon Log, LLC; (4) enforce the Holdon Log, LLC Terms of Use Agreement. 

We may view your file information (i.e. - file extensions, sizes etc. but not your file contents) for Application and system maintenance purposes.

You acknowledge and agree that Holdon Log, LLC may occasionally send you administrative communications regarding your Application and Service Account via e-mail. You may unsubscribe at anytime.

Cookies and Passive Data Collection

Holdon Log, LLC automatically receives and records information on our server logs from your browser, including your IP address, cookie information, and the page you request.

Holdon Log, LLC uses cookie, IP address, and URL information to improve and further develop the Application and Service, and to provide enhanced features to Users, where available. Holdon Log, LLC uses cookies to save User screen names, session validators, and on Users' browsers and hard drives, and may use them to provide tailored products and services to those Users, as they become available.

IP Addresses also help us to diagnose problems with our servers, to administer the Application and Service, and to otherwise provide the Application and Service to our Users.

Users should be aware that other Web sites visited before entering the Application and Service might place Personal Data within a User's URL during a visit to their Web site, and Holdon Log, LLC has no control over such Web sites. Accordingly, some of this information may be logged by Holdon Log, LLC.

USER INFORMATION HOLDON LOG, LLC COLLECTS

Personal Data

Once you create an Account and sign in to the Application and Service, you are not anonymous to Holdon Log, LLC.

When subscribing to the Application and Service, you provide Personal Data, which includes your name, a user name, confirmed e-mail address, a password, postal address, zip code, and credit-card number or other billing information to process your subscription request, as well as to manage your online account.

When logging in with the Application and Service, you send us that Personal Data and you may also send other Personal Data and information, including names of files and various sensitive information pertaining to your career (including but not limited to Contacts, Locations, Income & Expense Information, Appointment Details, etc.). Holdon Log, LLC may also record your IP address when you submit information.

Holdon Log, LLC also may collect certain preference and demographic information from you.

To protect your account information, please keep your password secure.

Holdon Log, LLC does not intentionally gather Personal Data about visitors/users who are under the age of 16. The only way a minor can be member is if parent or guardian has purchased an Account, and is held responsible for all payments and abides by the Terms Of Use Agreement in lieu of minor.

Paid Products and Services

We may charge fees for select premium content, products, and services. To enable the purchase of these products, we may collect and store billing and encrypted credit-card information. This information will only be shared with third parties who perform tasks required to complete the purchase transaction. Examples of this include fulfilling orders and processing credit-card payments.

Links to Third Party Sites

The Application and Service may contain links to other sites that are not under our control. These Web sites have their own policies regarding privacy. You should review those policies before visiting the Web sites. We have no responsibility for linked Web sites, and we provide these links solely for the convenience and information of our visitors and Application and Service Users.

Log Files
Log data is only used in aggregate to analyze usage of our Web site Application and Service.

Statistical Analysis
The Application and Service may perform statistical, demographic, and marketing analyses of subscribers and their subscribing and purchasing patterns, for product development purposes and to generally inform advertisers about the nature of our subscriber base. We also use such information to allow advertising to be targeted, in aggregate, to Users for whom such advertising is most pertinent.

Aggregate Statistical Information
Your Personal Data, including the data you enter and files you upload with the Application and Service, will be utilized by Holdon Log, LLC for purposes of Aggregate Statistical Information. "Aggregate Statistical Information" means a set of information containing your discrete Personal Data combined with the discrete Personal Data of subscribers in a manner where no individual parties can reasonably be directly identified. You agree to allow us to disclose and publish this Aggregate Statistical Information to any parties, through any means, including without limitation through press releases, advertising or similar communications, including community statistics provided within the Application and Service.

Please be assured that this Aggregate Statistical Information will in no way personally identify you or any other subscribers of the Application and Service.

DISCLOSURES

Sharing Your Personal Information

Holdon Log, LLC is committed to protecting your privacy. Holdon Log, LLC will not, under any circumstances, rent, sell, or give away your Personal Information nor does Holdon Log, LLC trade or exchange mailing lists with any other organization. Holdon Log, LLC maintains this information; but we may disclose your Personal Information to third parties if we believe that such action is necessary to (1) comply with the law; (2) protect and defend the rights or property of Holdon Log, LLC; (3) enforce the Holdon Log, LLC Terms of Use Agreement.

Law Enforcement; Subpoenas

Holdon Log, LLC may disclose Personal Data, including the data you enter and files you upload with the Application and Service, with or without notice (a) if required by a subpoena or other judicial or administrative order, (b) where required by law, or (c) at our sole discretion, where we deem it necessary to protect the safety of any individual or the general public or to prevent violation of our Terms of Use Agreement or the rights of Holdon Log, LLC or any third party.

Change of Ownership

In the event of a change in ownership, or a direct merger or acquisition with another entity, we reserve the right to transfer all User information in conjunction with the Application and Service, including Personal Data, to a separate entity. We will use commercially reasonable efforts to notify you (by posting on our Web site or an email to the email address you provide when you register) of any change in ownership, merger or acquisition of Holdon Log, LLC's assets by a third party, and you may choose to modify any of your registration information at that time.

Purchase Transactions

Purchase transactions through the Store/"Join Now" area which is accessible through the PerformerTrack Web site, as well as the Online Application & Service, End Users may be required to provide personal information (including credit card information) directly to a third party retailer in connection with the sale of Products/Membership/Service through the Store/"Join Now" area, and any information so disclosed to such third party shall be governed by such third party's privacy policy.

SECURITY

Holdon Log, LLC uses industry standard security measures to protect the loss, misuse and alteration of the information under our control. Although we make good faith efforts to store the information collected by the Application and Service in a secure operating environment that is not available to the public, please understand that no data transmission over the Internet or data repository can be guaranteed to be 100% secure. As a result, while Holdon Log, LLC strives to protect your personal information and privacy, we cannot guarantee or warrant the security of any information you disclose or transmit to us online and cannot be responsible for the theft, destruction, or inadvertent disclosure of your personal information. Further, while we take reasonable steps to ensure the integrity and security of our network and systems, we cannot guarantee that our security measures will prevent third-party "hackers" from obtaining this information.

UPDATING OR REMOVING USER INFORMATION

You may, at any time, choose to correct or update the information you have submitted to Holdon Log, LLC, by updating your Account on the Application and Service.

If you cancel your account, your Personal Data and other information may be retained in our archive or backup records for a period no longer than 90 days following the cancellation.

REVISIONS TO THIS POLICY

Holdon Log, LLC reserves the right in our sole discretion to revise, amend, or modify this policy and our other policies and agreements at any time and in any manner. Notice of any revision, amendment, or modification of this policy will be posted on the PerformerTrack.com Web site, and a User's continued use of the Service will signify agreement to such changes.

ACCEPTANCE

This Privacy Policy is incorporated into and subject to the terms and conditions of Holdon Log, LLC's Terms of Use Agreement. Use of the Application and Service is subject to your compliance with those Terms of Use, which constitute a legal agreement between you and Holdon Log, LLC. Each time you use the Application and Service you signify that you have read, understood and agree to be bound by the Terms of Use, which incorporates the Privacy Policy, and the applicable posted guidelines. USE OF THIS APPLICATION AND SERVICE SIGNIFIES THE ACCEPTANCE OF THE TERMS OF USE AGREEMENT AND THE PRIVACY POLICY. If you do not agree with the terms of either of these documents, please do not provide Holdon Log, LLC with any information and do not use the Application and Service or this Web site. Your continued use of the Application and Service in light of changes to this statement, to the Privacy Policy or to the relevant principles will signify your acceptance of the changes.
